OVERVIEW Welcome to Staples Creative. The terms "we", "us" and "our" refer to Staples Creative, a trading name of Liam Staples, a sole trader registered in England and Wales. Staples Creative operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Staples Creative is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy which can be viewed here. If you do not agree, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you are the age of majority in your jurisdiction, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 - OUR PRODUCTS We have made every effort to provide an accurate representation of our products and services. However, colours or product appearance may differ from how they appear on your screen due to your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased will meet your expectations or be identical to how they are depicted in our store. All product descriptions are subject to change at any time at our sole discretion.
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.
SECTION 3 - ORDERS When you place an order, you are making an offer to purchase. Staples Creative reserves the right to accept or decline your order for any reason. Your order is not accepted until Staples Creative confirms acceptance and processes your payment.
Please review your order carefully before submitting. For custom and personalised orders, once production has begun we may be unable to accommodate cancellation requests. In the event we do not accept or cancel an order, we will notify you by the contact details provided at checkout.
Your purchases are subject to our Refund Policy. Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are not affected, save that the right to cancel does not apply to personalised or custom-made goods once production has commenced.
SECTION 4 - PRICES AND BILLING Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. All prices are displayed in pounds sterling (GBP).
You agree to provide current, complete and accurate payment information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct and complete; (ii) you are authorised to use the payment method provided; and (iii) charges incurred by you will be honoured by your payment provider.
SECTION 5 - SHIPPING AND DELIVERY All delivery times quoted are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our reasonable control. Risk of loss passes to you upon successful delivery to your specified address. If a delivery attempt fails due to reasons within your control, re-delivery charges may apply.
Free standard delivery is available on orders over £100 as stated on our website. Delivery thresholds and charges are subject to change.
SECTION 6 - INTELLECTUAL PROPERTY All content on our Services, including trademarks, text, images, graphics, designs and product images, are owned by or licensed to Staples Creative and are protected by applicable intellectual property laws.
You may use our Services for your personal, non-commercial use only. You must not reproduce, distribute, modify or transmit any material from our Services without our prior written consent. All rights not expressly granted are reserved by Staples Creative.
By submitting artwork, logos or other materials for use in a custom order, you confirm that you have the right to use those materials and that their use will not infringe the intellectual property rights of any third party. You indemnify Staples Creative against any claims arising from your submission of infringing materials.
SECTION 7 - OPTIONAL TOOLS You may be provided with access to tools offered by third parties as part of the Services. We provide access to such tools "as is" without any warranties or endorsement. We shall have no liability arising from your use of optional third-party tools.
SECTION 8 - THIRD-PARTY LINKS Our Services may contain links to third-party websites. We are not responsible for the content or accuracy of any third-party sites. If you leave our Services to access a third-party site, you do so at your own risk.
SECTION 9 - RELATIONSHIP WITH SHOPIFY Staples Creative is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make are made directly with Staples Creative. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Staples Creative, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Staples Creative.
SECTION 10 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy which can be viewed here. By using the Services, you acknowledge that you have read our aforementioned Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain information about your access to and use of the Services in order to provide and improve the Services for you.
SECTION 11 - FEEDBACK AND REVIEWS If you submit any feedback, reviews, suggestions or other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and distribute such content for any purpose related to our Services.

No Agent may conceal that interactions are from an Agent, complete CAPTCHAs, or circumvent any measure intended to control Agent access. You will remain liable for all amounts due up to and including the date of termination. Sections relating to intellectual property, feedback, disclaimer of warranties, limitation of liability, indemnification and governing law will survive termination.

We do not guarantee that the Services will be uninterrupted, timely, secure or error-free.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.
SECTION 17 - LIMITATION OF LIABILITY To the fullest extent permitted by law, Staples Creative, its partners, employees, affiliates and agents shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Services or any products purchased through the Services.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded under applicable UK law; or (d) your statutory rights as a consumer.
